LovePop Inc that featured on Shark Tank in 2015 and gained investment from Shark Kevin O’Leary has been on a run this year for raising WIPO cases, you can see from the table below that LovePop Inc has filed 3 x WIPO Cases in 2021 and successfully won two cases to date securing 5 domain names in the dot com extension but now they are also going after CCTLD’s too with the most recent WIPO case filed in Australia for LovePopCards.com.au

In the previous case for LuckyPopCard.com, LovePop Inc stated the below when filing their case.

The Complainant creates laser-cut three-dimensional (“3D”) pop-up greeting cards. It was founded in 2014 and presented its business on the “Shark Tank” television program in 2015. The Complainant markets its cards online through its own website, through LovePop retail locations in the United States and through third party retailers in the United States and abroad. The Complainant’s trademark registrations include United States trademark registration number 4,730,483 for LOVEPOP, registered on May 5, 2015, with a claim of first use in commerce on March 29, 2014, specifying greeting cards and other goods in class 16; United States trademark registration number 5,961,804 for LOVEPOP, registered on January 14, 2020, with a claim of first use in commerce on June 1, 2014, specifying custom design of greeting cards and other services in class 42; and United States trademark registration number 5,961,803, for a device consisting of an image of the silhouette of an opening greeting card with a heart in the center (the “LovePop device”), registered on January 14, 2020, with claims of first use in commerce on March 29, 2014 and June 1, 2014, specifying goods and services in classes 16 and 42. Those trademark registrations remain current. The Complainant has also registered the domain name , which it uses in connection with its website.

As you can see the company plans to protect its trademark and I don’t think these will be the last three WIPO cases brought upon domain name owners or companies using their trademark terms as highlighted above.

The video below shows how LovePop Inc went from $300,000 USD investment to turning over millions in sales since this investment by Kevin O’Leary.

LovePop Inc has since raised even more capital of over $12.5 Million USD by Highland Capital Partners as they plan to take a bigger share of the $2 Billion Dollar card market.

Have you used a LovePop card product and do you think they are doing the correct thing by protecting their brand with these WIPO cases?
